On April 26, 2010, under the orders of Maryland, Govern Martin O’Malley and some Local Government Officials Detective Kenneth Penrod ID#729 of the Montgomery County; Maryland Police went into Prince George's County, Maryland and illegally arrested a member of the National Organization for Justice because the member had obtained evidence of criminal acts by Maryland, Govern Martin O’Malley and this Local Officials. To try and discredit the member Detective Penrod was ordered to take the member to a hospital and be tested.
On April 26, 2010, Detective Penrod transported Mr. Moment who he had placed under arrest for threatening Maryland, Govern Martin O’Malley and this Local Officials to Shady Grove Adventist Hospital of Montgomery County, Maryland and not too the County Jail to be processed. Upon entering the hospital Mr. Moment informed the hospital staff that he was illegally arrested and that he was not consenting to any medical test and if any tests that were run would be against his will. Mr. Moment refused to sign any paper work authorizing any test. The Shady Grove Adventist Hospital of Montgomery County, Maryland ran the test anyway and found no illness with Mr. Moment and informed Mr. Moment he could leave.
Because Shady Grove Adventist Hospital of Montgomery County performed those test on Mr. Moment with out his consent or will. Mr. Moment filed a complaint with the Maryland Department of Health complaint # MD0005088. On May 25, 2010, the Maryland Department of Health and Mental Hygiene sent the following letter to Mr. Moment.

The Office of Health Care Quality within the Department of Health and Mental Hygiene has received your complaint against Shady Grove Adventist Hospital. The nature and the complexity of the complaint will determine the priority and scope of the investigation of your complaint as required by Maryland law and federal requirements. Our role in complaint investigations is to determine if the care provided was in compliance with regulations. If your complaint also includes issues related to a bill, this office will not investigate billing issues and those complaints will be referred to the Health Care Advocacy Unit of the Office of the Attorney General.
Maryland law requires that non-life threatening complaints be referred to the facility for internal investigation and the investigation be submitted to this office within 30 days. Upon receipt of the facility's internal investigation, we will review the documentation to determine what additional investigation is required which may include onsite investigation or obtaining additional documentation.
While the investigative process begins immediately, the average complaint takes about 45 days to complete. When we have completed our investigation, we will apprise you of the results in writing.

After taking 44 days to investigate Mr. Moment’s complaint, The Office of Health Care Quality sent Mr. Moment the following letter. In the letter Mr. Paugh states that the staff of the Office of Health Care Quality was unable to substantiate concerns alleged in your complaint. Mr. Moment’s complaint was that Shady Grove Adventist Hospital ran test on him against his will or consent. Mr. Paugh states that the staff of the Office of Health Care Quality cannot confirm that the incidents happen.
After the National Organization for Justice posted a news story on their news web site where a search and seizure warrant that was issue by the Montgomery County Circuit Court was posted. In that warrant Detective Penrod states he transport Mr. Moment to Shady Grove Adventist Hospital for an emergency evaluation that was ordered. Mr. Moment e-mail the news story to the Maryland Department of Health and Mental Hygiene and on July 12, 2010, the Maryland Department of Health and Mental Hygiene sent Mr. Moment the following letter:

Dear Mr. Moment:
As a result of your email and phone call voicing dissatisfaction with the findings of the investigation of the above named complaint against Shady Grove Adventist Hospital, I reviewed the surveyor's investigation and discussed it with our counsel.
Review of the medical record revealed that you were brought to the emergency department by police on Emergency Petition (EP) with an arrival time of 1358 on 04/26/2010. When the police file an EP and bring a patient to the hospital, under the law, the hospital is required to provide a Medical Screening Examination (MSE) to ensure that the patient does not have an emergency medical condition.
The EP indicated that you had displayed behaviors that were threatening to others. This office has no authority to determine if the police acted appropriately.
The medical record showed that lab work was completed including a drug abuse screening, urinalysis, and blood-work to determine if there was a medical reason for the behavior. You were seen by a representative from the Montgomery County Crisis Center to evaluate any behavioral health needs. Based on the completed MSE, you were medically cleared and you did not meet criteria for inpatient psychiatric hospitalization, and you were therefore discharged stable. Review of the medical record and other pertinent documentation revealed that care provided was appropriate and no deficiencies were found or noted.
This office has no jurisdiction over billing, which is handled by the Health Care Advocacy Unit of the Office of the Attorney General. Thank you for reporting your concerns to our office.

In the above letter Ms. Webster states that Mr. Moment was brought to the emergency department by police on a Emergency Petition. Under the Maryland Code, Health-General Article § 10-620 which states that the following things must happen to obtain a emergency petition:
Their needs to be a (Case No), the Petitioner needs to present to the court evidence that the (evaluee) has shown the symptoms of a mental disorder and presents a danger to the life or safety of the (evaluee) or others and the Court having reviewed the Petition evidence and considered all pertinent data presented, to the court, and the court finds probable cause to believe that the named individual (evaluee) has shown the symptoms of a mental disorder and presents a danger to the life or safety of the him/her self or others the court therefore, will ORDERS that any peace officer take into custody and transport the (evaluee) to the nearest emergency facility, for examination by a physician within six hours after arrival at the facility and, if in the physician's opinion necessary, for emergency care and treatment; provided that the facility may not keep the (evaluee) for more than 30 hours under this Order but is not precluded from voluntary or involuntary admission in accordance with Maryland Code, Health-General Article.
On April 30, 2010, the National Organization for Justice sent investigators to the Montgomery County, Maryland District and Circuit Court and pulled all cases pertaining to Mr. Moment in Montgomery County, Maryland there was no Emergency Petition filed in the District and Circuit Court for Montgomery County.
Under Maryland Code, Health-General Article § 10-624 a. (1),
(a) Duty of peace officer. (1) A peace officer shall take an emergency (evaluee) to the nearest emergency facility if the peace officer has a petition under Part IV of this subtitle that:
Detective Penrod arrested Mr. Moment in Prince George’s County, Maryland, where Detective Penrod arrested Mr. Moment there was a hospital two min from that location. Detective Penrod did not take Mr. Moment that hospital (Prince George’s County Emergency Facility) but transported Mr. Moment to the Shady Grove Adventist Hospital in Montgomery County, Detective Penrod passed up several emergency facilities to take Mr. Moment to Shady Grove Adventist Hospital.
Under the Constitutional of the United States Mr. Moment has a right to choose and not choose medical treatment. Under the Fourth Amendment every citizen of the United States has a right to be secure in his or her own person. No court can decide if an citizens needs to be test, is this not what the Germany did to the Jews pull them of the street and ran test on them. What Ms. Webster stated in the above letter is what a war criminal would say “I was following orders” again at not time did or have Mr. Moment been charge with threaten or murder. Mr. Moment has not been brought before any court on the charges that Montgomery County, Maryland Judicial System keeps stating they have found probable cause of.
The National Organization for Justice and Mr. Moment has submitted a notice of intent to file a Civil Suit against the Montgomery County Police, Montgomery County, Maryland, Detective Kenneth Penrod and the State of Maryland in the amount of Five Billion Dollars to Annapolis, Maryland.
